This is a draft and has not been reviewed by a solicitor. Before trading, it must be reviewed and finalised by a Hong Kong practising solicitor, with the full company name and Business Registration number filled in. Until then it is for internal reference only.
These terms form the contract between you and Hashpoint HK 算點科技 [Business Registration number: to be added]. Unless we agree otherwise in writing, every quotation, order and delivery is governed by them. Where anything said verbally by a salesperson conflicts with these terms, these terms prevail.
The market price of second-hand graphics cards moves. If a quotation has expired we reserve the right to requote. Deposits are non-refundable if you cancel, because we begin sourcing and testing cards as soon as the deposit is received.
Risk passes to you when the goods are handed to you or to anyone you nominate to receive them. Delivery, carrying, electrical work and any alteration to your premises are at your cost and are not included in the machine price. Delivery is quoted separately if required.
All sales are final. We do not accept returns or give refunds because you changed your mind, chose the wrong model, found the site unsuitable, found electricity more expensive than expected, earned less from mining than hoped, or because a coin price fell.
Hong Kong law provides no statutory cooling-off period for ordinary retail sales. We also offer a power assessment and a calculator before any sale, precisely so the numbers are settled before you pay.
If goods are faulty or do not match their description, this is handled under the warranty in section 5 — see also section 11 on your statutory rights.
Every machine carries a 6-month warranty from the date of delivery, covering parts and labour on:
We will repair or replace at our option. Replacement parts may be refurbished items of equivalent specification. The warranty is not extended by a repair, but each repair itself carries its own 6-month warranty (see section 7).
The graphics cards are second-hand or refurbished (see section 8). The warranty covers hardware failure, not the remaining service life of a used card.
Outside the warranty period, or for damage the warranty does not cover, repairs are subject to a minimum charge of HK$200, quoted on the actual work, with delivery charged separately. We diagnose and quote first, and only begin work once you agree in writing.
Chargeable or not, every completed repair carries a 6-month warranty on that repair: if the same fault returns, we fix it again at no charge.
The AMD Radeon RX 6600 XT went out of production years ago and all available supply is second-hand or refurbished. We state plainly that the graphics cards in our machines are not new. Every card is stress-tested and re-padded before assembly, and cards that fail testing never leave the bench. You are buying tested second-hand hardware, and this is disclosed before any sale.
We sell computer hardware only. We are not licensed by the Securities and Futures Commission, we give no investment advice, and we express no view on the value of any digital asset.
Hashrate, power and revenue figures on this site are typical tuned results or estimates, not guaranteed values. Cryptocurrency mining can lose you the entire sum you put in.
To the fullest extent the law allows, our total liability for any claim is limited to the amount you actually paid for the goods concerned.
We are not liable for loss of revenue, loss of profit, loss or depreciation of digital assets, business interruption, electricity costs, or any indirect or consequential loss.
Nothing in this section excludes or restricts liability for death or personal injury caused by our negligence, or liability for fraud — the law does not permit those to be excluded.
These terms do not affect your statutory rights under Hong Kong law. Under the Sale of Goods Ordinance (Cap. 26), goods must be of merchantable quality and match their description. Under the Control of Exemption Clauses Ordinance (Cap. 71), any term attempting to exclude those statutory conditions against a buyer dealing as a consumer is void.
So the "all sales are final" rule in section 4 applies to change of mind and similar situations. It does not affect the rights the law gives you when goods are faulty. If you buy in a business capacity rather than as a consumer, the limitations in these terms apply so far as is reasonable.
These terms are governed by the laws of the Hong Kong Special Administrative Region and are subject to the non-exclusive jurisdiction of the Hong Kong courts.
